Newborn’s Infection Progresses to Meningitis Not Guilty

T his case involved a newborn who had been discharged by defendant doctor 36 hours after birth, but was admitted the next day to a different hospital with possible sepsis. He ultimately developed meningitis which irreversibly damaged his neurological system. The plaintiff, age nine at time of trial, was non- verbal and suffered from severe brain damage
and cerebral palsy. Plaintiff’s counsel argued that the doctor that discharged plaintiff failed to fol- low standard of care by discharging the plaintiff less than 48 hours after birth despite test results that indicated he should stay in the hospital. The defense argued there were no signs of infection prior to his discharge and the newborn’s rapid decline post discharge supported their argument.
