T his case involved a 34-year old women exiting the CTA “L” station at Randolph/ Wabash on a December morning. As she was walking down the staircase to the street level, she slipped and fell down seven stairs suf- fering back and leg injuries with expected future surgeries. Plaintiff contended the stairs lacked
anti-skid plates and a handrail. The defense contended there was an overnight storm that covered the stairs with ice and freezing rain, and that was the sole proximate cause of the plain- tiff’s fall. The defense also argued that there was a handrail and that some of plaintiff’s injuries were based on pre-existing conditions.
