T he plaintiff in this case was suffering from a large thoracic disc herniation that was compressing his spinal cord and he underwent a discectomy procedure. During the procedure a neurophysiology technician moni- tored the intraoperative neurophysiology signals, but never informed the surgeon of signal abnor-
malities. The plaintiff sustained substantial spinal cord damage permanent paraplegia and bladder and bowel disfunction. The defense argued that the doctor’s choice of approach was appropri- ate and within the standard of care. In addition, the defense denied that the surgical approach or technique were the cause of the plaintiff’s injuries.
