T his case involved a vehicle pulling out from a stop sign and striking another vehicle on the passenger side travelling 45 miles an hour, causing that vehicle to spin around onto the grass. The case was tried in Cook County and involved both medical and accident reconstruc- tion experts. The plaintiff (M-62) aggravated a
pre-existing lumbar degeneration that required lumbar fusion surgery. There were complications after the fusion that led to a pulmonary embolism and later death. The defense claimed the plaintiff could have avoided the accident, was travelling at an improper speed and that he would have re- quired the fusion surgery regardless.
