Intubation Issues Lead to Hypoxia and Brain Injury Not Guilty

T his case involved a 42 year old male who suffered brain damage while being treated for DTs at defendant hospital. The Cook County trial lasted two weeks and in- cluded a dozen doctors and experts. The plain- tiff presented to the emergency room suffering from DTs and had a history of alcohol with- drawal. Plaintiff’s counsel claimed that plaintiff

suffered hypoxia due to an improper intubation by a resident. The plaintiff now has significant functional and cognitive deficits and is confined to a wheelchair, requiring 24-hour care. Plain- tiff’s experts identified the hypoxia as the main reason for the brain damage. Defense experts argued that the deficits related to plaintiff’s al - cohol abuse were the cause of the hypoxia.
