T he plaintiff in this case was a 54 yr-old truck driver who was picking up a load of steel conduit at the defendant’s fa- cility. Normally, a tarping machine would au- tomatically cover the load with a tarp. On this occasion, plaintiff was asked to cover the load
manually. While covering the load, plaintiff slipped and suffered serious injuries to both ankles that required six surgeries. There was dispute about whether the tarping machine was not working and whether plaintiff was asked to manually cover the load.
