T he Chicago Rush Arena Football team leased space from Soccer City in Paletine. The Chicago Rush equipment manager brought his 5-year-old son to work. The son was attempting to close a gate when it detached from the wall and fell on him causing a femur fracture that required two surgeries. The son also alleg- edly suffered from PTSD and emotional distress.
Pltf argued that deft failed to properly inspect, main- tain and repair the premises. Pltf’s expert testified that the gate anchors at Soccer City had been dete- riorating for years and deft failed to have a preven- tative maintenance program. Deft argued it acted reasonably / had no notice of the alleged defective condition / and filed a counterclaim against the fa - ther for contributory negligence.
