Delivery of malpositioned baby resulted in brain damage

A women 32 weeks pregnant with twins went into labor and pre- sented to Defendant hospital. One of the twins (Plaintiff) was determined to be in a breech position, doctors decided to per- form a C-section delivery. The attending obstetrician and two obste-trical residents maintained the delivery was complicated because the Plaintiff was malpositioned and each of them was unsuccessful in their attempts to deliver his head, requiring additional measures for better access to deliver him. Plaintiff was born with bruises all over his body and alleg- edly had two skull fractures. Plaintiff was diagnosed with a massive brain bleed, resulting in widespread brain damage, and substantial develop- mental delays. Paintiff’s experts contended the skull fractures were di- rectly caused by the doctors’ traumatic delivery. The Defendant argued that Plaintiff suffered intrauterine hypoxia one to two weeks before he was born, the bruising was not consistent with the delivery efforts, and the doctors were never in a position to cause the alleged skull fractures. The trial lasted over 3-weeks and involved 20 experts.
