Outstanding Cook County Defense Verdict in a Medical Malpractice Case
diagnosed with a massive intracranial hemorrhage within 24 hours, resulting in widespread neurological brain dam- age, extensive cystic encephalomalacia, spastic quadriplegia, and substantial developmental delays ($31,000,681 lifetime medical/caretaking expenses). The defense argued that Imran suffered intrauterine hypoxia one to two weeks before he was born based on placental, radiological, and hematological testing, he had bruises on parts of his body that were never touched during the delivery,
the amount of bruising at birth could not have occurred in the time it took to com- plete the delivery, and the bruises must have been due to a coagulopathy (which was diagnosed the day after his birth). The defense further maintained the doc- tors were never in a position to squeeze or crush the baby’s head during the delivery and the alleged skull fractures were actually accessory sutures (fibrous joints between the bones of the skull). The defense firm was brought into the case in 2018, less than a year before trial.
