The 2025 JVR Settlements Report had the highest num- ber of settlements and total amount for pedestrian cases with 46 cases totaling more than $145 million. The previous high was in 2022 with 42 cases with a total amount of $136 million. Compared to 2024, the number of cases increased 53% and from 30 to 46 cases this year. The total amount rose 60% to more than $145 million from $90 million. Pedestrian cases were 7% of the total number of cases as well as the total settlements amount. Both the average and the median amounts for settlements re- mained essentially the same. The 2025 average for a pedestrian case increased 5% to $3.2 million from $3 million in 2024. The median settlement dropped 5% to $950,000 in 2025 from $1 mil- lion last year.

The majority of pedestrian cases were settlements. Only 12% of cases went to trial. Of the six cases that went to trial, all but two resulted in a verdict for the plaintiff. Cook County settlements made up 88% of the total amounts with $128 million versus $10 million in the other Illinois counties. The highest pedestrian settlement was a Cook case involving a pedestrian hit by an SUV being chased by police. The crash re- sulted in bilateral below-the-knee amputation. Power Rogers LLP handled the $32 million settlement. The average Cook County settlement ($3.9 million) was more than double compared to non-Cook ($1.4 million).
