Delayed delivery of baby led to brain damage requiring 24-hour care

T he mother F-24 was 37 weeks pregnant when she was admitted to the Defendant hospital for high blood pressure and monitoring. She was diag- nosed with preeclampsia and gestational diabetes and was discharged. The mother returned to the hospital two days later and received a fetal heart monitor that was deemed normal and Defendant doctor discharged her with a plan for induction 6 days later. However, 4 days later the mother felt decreased fetal movement and returned to the hospital. Upon arrival the mother was placed on a fetal monitor which showed distress, then over the course of several hours she was taken off the fetal monitor to have an ultrasound and review by a radiolo- gist. When the mother was finally put back on the fetal monitor, the baby’s heart rate had dropped, a physician was called to perform an emergency C-section, and the baby was delivered. The newborn required prolonged resuscitation immedi- ately after delivery with Apgar scores indicating significant oxygen deprivation. The baby suffered severe brain damage that left him with significant physical and cognitive disabilities. He will require nursing care and supervision 24 hours per day for the rest of his life.
