SETTLEMENT: $20,000,000 (IL, Lake 19th Jud Cir)

PLTF ATTY(S): J. Matthew Dudley, Marisa Schostok of Dudley & Lake (Chicago, IL) Daniya (13) was being treated for meningitis/encephalitis on February 28, 2016 at the E/R. Allegedly continuous pulse oximetry monitoring was discontinued when Daniya was transported to radiology. Daniya suffered a hypoxic injury as a result and now requires constant care as a resident of Misericordia ($1,800,000 medl. expense). Nurses testified that the nasal cannula had been kept in place but CT images did not show any plastic tubing around the child’s face or nose. Defense claimed that the mother failed to provide a complete history including an event where Daniya had been tested for ocular myasthenia gravis. While Daniya tested negative for the disease, defense argued that had this detail been provided, they would not have discontinued monitoring. The E/R physician who ordered the monitoring testified the nursing staff should not have discontinued it in any event. $10,000,000 was paid by the partially self-insured hospital and $10,000,000 by Allied World (excess carrier). This is the highest reported Lake County medical malpractice settlement.
